1. Eligibility

You must be at least 13 years old, or the minimum legal age required in your jurisdiction, to use Caltrac.ai. If you are in Australia, you must be at least 15 years old. By using our Services, you represent that:

• You are legally permitted to enter into these Terms.
• The information you provide is accurate and current.
• You will comply with all applicable laws while using the Services.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

• Provide accurate account information.
• Keep your login credentials secure.
• Notify us immediately of any unauthorized access to your account.
• Accept responsibility for activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Description of Services

Caltrac.ai provides AI-powered nutrition tools designed to help users:

• Track meals
• Estimate calories
• Monitor macronutrients
• Maintain nutrition goals
• Analyze food using artificial intelligence
• View nutrition insights

Caltrac.ai is intended for informational and educational purposes only.

5. AI-Generated Content

Caltrac.ai uses artificial intelligence to recognize foods and estimate nutritional information. Although we strive for accuracy:

• AI results may be incomplete or inaccurate.
• Food recognition is not guaranteed to be correct.
• Nutritional estimates should be considered approximations.
• Users remain responsible for verifying important dietary information.

Caltrac.ai does not guarantee the accuracy, completeness, or suitability of AI-generated content.

6. Acceptable Use

You agree not to:

• Use the Services for unlawful purposes.
• Attempt to gain unauthorized access to our systems.
• Reverse engineer or interfere with the Services.
• Upload malicious software or harmful code.
• Use automated tools to scrape or overload our Services.
• Impersonate another individual or organization.
• Submit false or misleading information.

Violation of these Terms may result in suspension or permanent termination of your account.

7. User Content

You retain ownership of the information and content you submit to Caltrac.ai, including:

• Food logs
• Images
• Nutrition entries
• Personal notes

By submitting content, you grant Caltrac.ai a limited, non-exclusive license to process and use that content solely for the purpose of operating, maintaining, improving, and providing the Services.

You represent that you have the necessary rights to submit all content you upload.

8. Privacy

Your use of Caltrac.ai is also governed by our Privacy Policy. By using the Services, you acknowledge that you have read and understood our Privacy Policy.

9. Intellectual Property

All software, logos, trademarks, graphics, designs, text, and other materials provided by Caltrac.ai are owned by or licensed to Caltrac.ai and are protected by applicable intellectual property laws. You may not:

• Copy
• Modify
• Redistribute
• Sell
• License
• Reverse engineer
• Create derivative works

without our prior written permission, except as permitted by law.

10. Service Availability

We strive to keep Caltrac.ai available at all times. However, we do not guarantee uninterrupted or error-free operation. We may:

• Modify features
• Perform maintenance
• Suspend portions of the Services
• Discontinue features

without prior notice when reasonably necessary.

11. Third-Party Services

Caltrac.ai may integrate with or access third-party services, including Apple Health, Google Health Connect, cloud providers, analytics services, and authentication providers. These services are governed by their own terms and privacy policies.

Caltrac.ai is not responsible for the content, availability, or practices of third-party services.

12. Disclaimer of Warranties

The Services are provided on an “AS IS” and “AS AVAILABLE” basis. Subject to Section 13A and to any rights you have under applicable consumer protection law that cannot be excluded, Caltrac.ai disclaims all warranties, whether express or implied, including warranties of:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy
• Reliability
• Availability

We do not warrant that the Services will be uninterrupted, secure, or free of errors.

13. Limitation of Liability

To the fullest extent permitted by law, Caltrac.ai and its owners, employees, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

Our total liability for any claim relating to the Services shall not exceed the amount you paid to Caltrac.ai for use of the Services during the twelve (12) months preceding the event giving rise to the claim, or USD $100 if no payment has been made, whichever is greater.

This Section does not limit or exclude any liability that cannot be limited or excluded under the law that applies to you. If you are a consumer in Australia, Section 13A applies and takes priority over this Section.

13A. Australian Consumer Law

If you are a consumer in Australia, the Australian Consumer Law gives you rights and guarantees that cannot be excluded, restricted or modified by these Terms. Nothing in these Terms, including Sections 12 and 13, excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded by agreement.

Where the Australian Consumer Law permits us to limit our liability for a failure to comply with a consumer guarantee, our liability is limited, at our option, to supplying the service again or paying the cost of having the service supplied again.

14. Termination

You may stop using Caltrac.ai at any time. We may suspend or terminate your access if:

• You violate these Terms.
• Your use poses a security risk.
• We are required to do so by law.
• Continued operation is no longer commercially feasible.

Termination does not affect rights or obligations that accrued before termination.

15. Changes to These Terms

We may update these Terms from time to time. When material changes are made, we will update the Effective Date and provide notice through the application or website where appropriate.

Your continued use of Caltrac.ai after changes become effective constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law principles, and any dispute arising from them will be brought in the state or federal courts located in Tarrant County, Texas. If you are a consumer in Australia, this does not take away your right to rely on the Australian Consumer Law or to bring a claim in an Australian court or tribunal, and the mandatory laws of your place of residence continue to apply to you.

17. Connected Professionals

Caltrac.ai may let you connect your account with an affiliated professional, such as a coach, and share selected nutrition information with them — including your nutrition goals, your net-calories figure, and how it compares against those goals. This sharing happens only with your consent, and you can revoke it at any time.

• Any guidance, coaching, or advice a connected professional provides is solely between you and that professional.
• Caltrac.ai is not a party to that relationship and is not responsible for the advice, services, or conduct of any connected professional.
• You are responsible for choosing whom to connect with and what information to share.
• A connected professional's use of your information is governed by their own terms and privacy practices.

Nothing shared with a connected professional through the Services constitutes medical advice from Caltrac.ai. Please see Section 4 (Not Medical Advice).
